good morning. thank you for joining us. i'm laura garcia-cannon. >> i'm jon kelley. good morning. we start off with breaking news in san jose where arson investigators are there right now heading to that scene of a one-alarm fire at a business in san jose. this one happening north of highway 1 in an industrial area of north san jose. so far no injuries reported. and right now we're joined live by san jose fire spokesperson. what can you tell us about this fire? >> good morning, mr. kelly. we were dispatched for a report of smoke in a small commercial building. on arrival we noted a small fire controlled by the sprinkler activation with water throwing through the sprinkler head inside the building that was locked. so we had a forced entry and extinguished the fire. took us 25 minutes to extinguish it. upon entry we noted an odor of gasoline combined that it was a

commercial building early in the morning we consider this fire suspicious and have our arson unit en route to investigate it further. >> what can you tell us about what kind of building this is? we're hearing indication it is may be a pot club. >> we found that out after the fact, sir. it is a cannabis club so that only heightened our suspicions there may be something going on. >> what have we found inside? seen anything that makes it look suspicious or that arson could be involved? >> well, actually i can't comment on specifics we found until our arson unit does a full investigation. there were some suspicious objecti objects and a fire in a commercial building early in the morning and it was locked. our arson unit is en route. pd is on scene. we'll give you a full report when we collect the evidence. daylight will also help. >> all right. thank you very much for sticking around with us and answering our

questions. we appreciate it. great work out there to you and all of the firefighters. >> thank you very much. >> we appreciate you. 6:02. today a north bay mother will wake up once again knowing her teenage daughter is still missing. the family of 19-year-old alyssa byrne desperate for answers after she disappeared at a music festival in lake tahoe. "today in the bay's" marla tellez joins us from our newsroom with a look at how the search is expanding. >> reporter: authorities are searching in and around the hotel alyssa byrne was staying at with friends. that's the horizon hotel and casino. they are now extending that search for the skies flying high above lake tahoe hoping to see some sign of her. her friends last saw her inside the horizon hotel lobby. she just left a concert on south shore. this was new year's eve night before midnight. one friend tells us she didn't seem like herself like she was either drunk or on drugs. another friend reviewed surveillance tape with investigators and describes what he saw. >> basically it just showed her

sitting on the couch in the lobby and just all of a sudden getting up and walking away like someone was kind of wanted her to meet her somewhere or something or someone got her to get up and walk away basically. it looked like there was a reason why she left. >> reporter: her mother swears her daughter would never go anywhere with a stranger and is desperate for her to come home. >> all i need is hope. all of us need just one or two more footsteps closer to alyssa. that's all we need. one call. please. >> reporter: authorities say they are investigating the last ping on her cell phone which came in three minutes after midnight new year's day morning. at this point they're not releasing where that call or text came from. a $10,000 reward is being offered for byrne's safe return home and deputies with the douglas county sheriff's department are reviewing byrne's twitter account. some pretty interesting and emotional last tweets on that account. i'll have more on that coming up

in my next report. laura and jon? >> thank you very much. right now a follow-up to a story we first broke wednesday. san jose man accused of taking the law into his own hands has been officially charged with murder. luis hernandez accused of shooting and killing christopher soriano on new year's eve. hernandez telling police he was just frustrated that they were not responding to numerous calls for help after a rash of burglaries at an apartment complex. he also told police he thought soriano was a serial burglar and he tried to make a citizens arrest. the victim's mother is blaming the mayor for police staffing cuts. >> the mayor has to do something about the police force. he needs to hire more men. and i know budgets and -- cut somewhere else. don't cut the police department. we need more officers out there to prevent things like this from happening from other people being vigilantes and killing somebody. >> the mayor says he agrees with the need for more officers on

the street and the city is currently in the process of training 40 new police recruits. it's 6:05. neighbors who live right next to the flooded san francisquito creek in east palo alto want the city to fix it now. the city council declared a local emergency after recent storms damaged the levee. it is hopes that governor jerry brown would declare a state of emergency bringing money to cover the cost of repairs. a city inspection of the entire length of the creek shows 12 areas in need of immediate help. storms right before christmas caused the water to overflow its banks damaging seven homes. >> they just really should fix the levee. that's the main thing. fix it. >> we have found more serious damages to the levee and to the road and it is a very dangerous situation. >> the city of east palo alto is hoping governor brown will grant their emergency request by later today. it's the first feel good

friday of 2013. christina loren is telling us how it's shaping up outside. >> good morning. i'm feeling the good vibrations. hope you are too. temperatures are not as cold as yesterday morning. in fact, we're about five degrees warmer on average across the board. 32 in gilroy. 37 degrees right here in beautiful san jose. and as we head throughout the day today, return of the low clouds. watch out for patchy, dense fog at 8:00. then between 8:00 and 11:00 and by noon today all of that fog clears out of the area. we'll see a nice sunny finish and temperatures are actually going to warm up even more so from yesterday. and yesterday was a pretty nice day. 61 degrees inland today. 61 bayside. at the coast, 60 degrees for you. major changes on the way. rain on the way. we'll help you plan around the showers and give you the forecast coming up. first, let's check on your drive with mike. >> we see a few folks or did for a few minutes see a few folks

waiting at the bay bridge toll plaza as we show you this closer up. bottom of the screen i saw cars waiting on both sides of the fastrak lanes in the cash lanes itself. looks like they started to move again. there are cars that may represent a delay. no metering lights on yet. volume pretty good and heavier than we've seen for the last couple of fridays. just a note for folks heading into the city right now. map will show you the area still a smooth drive. slowing at the incline as you expect westbound in toward treasure island. here's the issue as well. east 24th still showing the slowing which is a typical pattern. a disabled vehicle clear as you head toward tunnel road. that's better news toward the tunnel. also just in we have a report of a delay for the b.a.r.t. system. ten-minute delay reported for el cerrito. out of el cerrito a ten-minute delay reported because of b.a.r.t. police activity that

could be anything that they are enforcing. we'll let you know if it's anything big. so far minor delays for the system. we'll track it and send it back to you. starting this weekend no more free parking in one bay area city. police in san francisco will start enforcing parking meters on sunday. "today in the bay's" christie smith live in san francisco with a look at some of the changes. it's been a long time coming for this one. >> reporter: good morning to you, laura. this is really going to take some getting used to because san francisco has had free parking on sundays at meters since way back in the 1940s. of course what's different is back then most stores weren't open on sundays and now they are. the idea is let's say you have a starbucks or cleaners across the street. they want to make sure that people don't just leave their cars all day and everyone has a chance to park and that the cars keep cycling through. everyone has a fair shot. starting this sunday the municipal transportation agency is saying pay up on sundays at all san francisco parking meters. some church groups are saying

this will leave their members running out in the middle of a sunday service just to pump quarters into the meters outside. the agency says that they are just going to run from noon to 6:00 on sunday. so you can also prepay or you can pay up to four hours so that shouldn't really be a problem. at this point the deal is done. >> it's meant to be a program that allows congestion to be relieved, parking to be more available and businesses to thrive because parking is more available for people coming to san francisco to shop. >> reporter: now the good news is there's a grace period of warnings that will be given out for the first three sundays until january 26th. that's when they will start issuing the real parking tickets that are not cheap. we're talking up to $72. fortunately they make it easy to pay giving you plenty of options. credit cards, debit cards, parking cards, coins, you can even pay with your cell phone. reporting live in san francisco,

period. according to court records, the narcotics officers would allegedly threaten women with jail time to get them into the car and then drive them to secluded areas where the officers would then demand sex. one of the alleged victims already filed a lawsuit. in new york city, three police officers are injured after two separate shootings. police say two plain clothes officers were shot in brooklyn while on patrol at a subway station. one officer was shot in the upper thigh and the other officer shot in the back. the suspect was shot and killed and then when officers returned fire. an off-duty officer was shot while working at his family's car dealership at the bronx. in this case the suspected gunman was subdued and arrested. all three officers are expected to survive. the time is 6:14. here's a quick check of the day's top stories. this one made worldwide headlines. a pakistani school girl shot in the head by the taliban has been released from the hospital walking out on her own power. she's going to live with her

family in the united kingdom. malala yousutzai will be readmitted next month for another round of surgery to rebuild her skull. that girl was air lifted to the u.k. back in october after being shot in her native pakistan on her way to school. helicopters will search the snowy areas of south lake tahoe for a petaluma teen who disappeared during a three-day music festival. 19-year-old alyssa byrne is from petaluma last seen new year's eve. former arizona congresswoman gabrielle giffords expected to attend the meetings with families of the victims of the sandy hook elementary school shooting. she was injured in a shooting rampage in tuesday. the big jobs report coming out just a short time ago. >> scott mcgrew is enthusiastic about some and not others. >> this is not a big month. has nothing to do with the numbers themselves. everything to do with the fact that what we're talking about is

december, which is a hard month to measure. lots of travel in december. temp jobs. the jobs report looks backwards. it's a trailing indicator. as we look back on december with about 155,000 jobs gained and unemployment rate of 7.8%, that's just not very much. it's not an increase really over november's 7.7% because economists went back and revised november back up to 7.8%. much unchanged and one of the reasons that i really tell you to ignore these small deviations in the unemployment rate in the first place. ignore it all together really. also new this morning, the state department frowning on eric schmidt's trip to north korea calling it bad timing considering north korea just launched a powerful rocket but they point out that they are private citizens and they can do what they wish. in a separate bit of news, ftc

today and we'll hit the mid 60s. it's not even as frigid as yesterday. we're starting off on a friday morning with milder temperatures for you. 43 in san francisco. 47 in san jose. 32 in gilroy to start the day. we do have an area of low pressure that will impact your forecast over the course of the week. we want to talk science for you this morning. jet stream you hear us talk about the jet stream. it's the river of air that actually carries our storm system like a conveyer belt across the united states from west to east. what's going to happen is we're going to see an area of low pressure break apart from the scream. we call we call it a cutoff low. it's hard to dictate where showers will end up. we've been watching this guy for quite a few days. a.m. fog and drizzle likely. temperatures dropping off as well. you're better off making outdoor plans on saturday than sunday with light rainfall in the forecast. let's talk about that timing it to your doorstep. we stop the clock at 5:00 p.m.

on saturday sun is going down and temperatures on the cool side. you can get outdoors for the first part of saturday before the rain moves in between 4:00 and 5:00. with he stop the clock for you again at 11:00 p.m. bulk of the moisture has come through. a stray shower or two on sunday afternoon as another wave comes through. overall not a washout of a weekend. 62 degrees in livermore today. this is the day for outdoor plans. 62 in gilroy. a lot of people actually still have the day off. as mike was saying, the commute will turn to normal on tuesday of next week. if you have the day off today, you can even hit the beach. santa cruz today, 63 degrees. our next chance for rain comes into play on wednesday. maybe a stray shower up in the north bay. not looking that promising at this point. 6:20. let's check the drive. >> let's start with south bay which had a gentle build in many spots and eased off again. we expect that lighter flow of traffic.

a gentler change reflected in sensors. let's show you. green. good. all right. over here toward the tri-valley, a little slowing through livermore. that started and then held with speeds just coming down into the 50s as you pass by arrowhead. no problem off that dublin interchange with south 680. a smooth drive as well for hayward with just a little bit of a build coming off the castro valley y. 880 and also toward san mateo bridge. we'll look out here by the bay bridge toll plaza where we do see a few cars starting to back up now in the cash lanes from time to time coming into view of the camera. just a few cars maybe a half dozen. fastrak lane not a problem. no metering lights. the east shore freeway shows a good volume but steady flow so there's no need for metering lights just yet. a look across the other bridge, san mateo bridge to the south. picking up volume but not lowering the speeds at all and smooth drive along the peninsula. i'm going to stop talking and send it back to you. 6:21 right now. giants pitcher sergio romo is apologizing to fans after he was

handcuffed and detained at a las vegas airport. happened on new year's day. las vegas place say that romo got into a hoeated confrontatio with a tsa agent forcing other agents to detain him. he wasn't arrested but was issued a citation for violating airport rules. romo issued a statement late yesterday. it reads in part i would like to sincerely apologize. i love and respect the giants, my teammates and our fans and promise to conduct my selves in the future in the san francisco giants way. after decades of just complete dominance, the curtain may drop on an era of football. it appears the coach is stepping down following his team's fourth straight state championship. these guys are a force. the school not confirming the speculation but there is a press conference today to discuss the future of the football program. he has 399 victories as a head

welcome back. it's friday. let's go big. we'll double your pleasure here. first a live look at san jose. still waiting for the sun to come up. it will be crisp and clear out there. we take you to the s-curve in san rafael. traffic at this early hour already picking up. we'll tell you about that with mike. christina will fill you in on the weather. it is 6:26. after a day-long delay votes for oscar nominations are due tonight. this is the first year the academy is letting members cast their ballots online. the votes were initially due yesterday but the deadline was pushed back after voters complained of issues with the website. voting wraps up tonight at 5:00. the list of nominees will then be announced on january 10th, which is always exciting. >> looks like a nice diverse list this year. you have "lincoln," and "argo"

in as we like to time this up. a beautiful way to start friday. markets hoping to continue the rise after fiscal cliff news. we'll keep you posted on this friday, january 4th. this is "today in the bay." good friday morning, everybody. thank you for joining us. i'm jon kelley. >> i'm laura garcia-cannon. new numbers into our newsroom this morning about the state of the american economy. scott mcgrew joins us in our newsroom with analyst. good morning. >> 155,000 jobs were added to the american economy in the month of december. that gives us an unemployment rate of about 7.8%. now, this still leads us 4 million jobs short of the american economy we saw before the huge credit crisis a few years ago. but it continues to be good

news. december a very tough number to crack because december is such an odd month. remember, we're always looking one month back. december you have lots of temporary jobs, holiday jobs at the mall, what not, a lot of people traveling as well. again, 7.8% on the unemployment rate in november it was 7.7%. don't consider that a tick up because economists have since changed their mind and called november 7.8% as well. this is neither good news nor bad news. it just is news and december is a bad month to try to figure this out. we're still 4 million jobs short of where we were just a few years ago. >> still a lot of work ahead. all right. thank you very much for the update. we can tell you governor jerry brown hard at work trying to prevent the fiscal cliff deal from taking a bite out of california's budget. the deal signed by president obama on wednesday won't let states keep a portion of revenue from the federal estate tax.

california has not received any revenue from that tax since 2004 but the brown administration included it any way when coming up with the state's current budget plan. officials had estimated receiving $335 million from that tax over the next year and a half. a spokesman for brown's administration telling "the l.a. times" they already figured out a way to get by without all that money but he did not offer any specifics. the governor is expected to unveil the new budget proposal starting next week. the huge fire at chevron's richmond oil refinery may have been ignited by firefighters. chevron firefighters responded to reports of a small leak in the 40-year-old pipe. photos from the investigation are showing something unexpected where the pipe had failed. the line appears to have been punctured from the outside. investigators say the damage could have happened accidentally as the insulation was being torn

away. >> sure we'll hear more about that one. a san francisco lawmaker now making bold moves proposing a new bill to protect the homeless. democratic assemblyman wants to give homeless the legal permission to solicit money and sleep in public without harassment. this measure will be controversial it cities like sacramento and san francisco where voters passed an ordinance against sitting or lying on sidewalks. >> a cold way to start your morning out there let's check the forecast with meteorologist christina loren. >> 6:33 and temperatures are running more on the mild side than just 24 hours ago. we're at 43 for instance in san francisco. we were at 38 degrees at this time yesterday. 34 in napa. 38 in sonoma. 32 at freezing this morning in gilroy. we traded in the upper 20s for more 30s and 40s this morning. you notice a difference when you walk out the front door. what's happening is we have more cloud cover serving as a blanket over the greater bay area. the clouds are going to continue

the station but no problem now. moving smoothly through the area. we'll focus on commute spots which aren't commute spots this morning. tri-valley east shore freeway looking smooth. north 101 off 680 shows slowing. traditional spot and lighter than normal for this friday. we'll end with a live shot along the peninsula for palo alto southbound side picking up a good number of headlights and number of cars but no slowing at the limit from san mateo down into palo alto and the south bay. back to you. thank you, mike. new this morning, an intriguing story here. stanford university researchers may have found what's causing young healthy athletes to suffer heart attacks. they discovered higher levels of calcium in patients with heart conditions. scientists known a genetic mutation is the reason behind abnormal hearts in athletes but they were not sure why the heart muscle was failing. stanford researchers say

steps to aid this effort. an interesting one. 10,000 shark fins have been found drying on top of a factory in hong kong this week. traders trying to hide their harvest have taken their product from the sea to the rooftop. look at that. the fins as you probably well know are delicacy in many parts of asia. very expensive culinary ingredient and according to environmental groups hong kong is responsible for about half of the global trade of fins. environmentalists say the way the fins are harvested is brutal and devastating to the shark population. >> they lay them out according to color to make it look like a pattern up there. that's bizarre. 6:40. coming up, mission in the sierra snow. a north bay family's desperate search for their teenage daughter. we'll have that information coming up. feeding that parking meter. how san francisco is cracking down to make sure you're paying

mild this morning. clouds return this morning. trapping in some of the warmth from yesterday serving as a blanket. mike is tracking things you'll want to know about. 32 degrees in novato. 43 in san francisco. 34 degrees cold out there in napa this morning. 32 for gilroy. temperatures have jumped up by five to seven degrees from just 24 hours ago. jet stream still well to the north taking the sto track into the pacific northwest and canada. for us we're not going to see too much of a change. that storm window isn't going to open. an area of low pressure will get cut off from the jet stream and saddle down the coastline throughout the weekend and bring us light precipitation mostly at the coast. core of low pressure will stay offshore. heavier rain and wind will remain over the ocean. fog and drizzle tomorrow morning. cloudy and cooler overall. we'll get light rainfall mostly at the coast. let's talk about that. stop clock at future cast.

mike. >> two things i just heard about as i was coming through. the first one is a big accident involving big rigs out of our area on highway 99 but a note for folks if you are traveling through central valley heading down to southern california, i-5 is okay. 99 sounds like there may be a closure in place for the next couple of hours. i'll check and get more details. i want you to get a quick alert. stick around until we sort this out for you. another issue i just heard about west 580 up toward 23rd. accident there. a crash here reported as you head through oakland. sounds like it is blocking one lane and maybe two. there will be slowing heading from san leandro into downtown oakland. a light flow of traffic. 880, 680, 580, no delays in commute directions through this area. eastbound for 580 a report of a disabled big rig sticking out a couple feet into the lanes. stay one lane over to your left. fast lane, middle lanes are okay as you head out of pleasanton into livermore.

is ev iser er iserono will appear in. they intend to seek the death penalty or life in prison without parole in the case. a teenager driver arraigned today. 19-year-old david morales accused of killing two people in a crash while leading police on a chase on new year's day. morales is a gang member who shot at three pedestrians before that police pursuit. a north bay child care center hit with criminal charges after the death of a 4-month-old boy last fall. this as the boy's parents file a wrongful death lawsuit. the coroner says the boy died after suffocating on his bedding. three staffers are charged with involuntary manslaughter. the child care center has since shut down. we can tell you a series of environmental stories making an impact both locally and nationally. >> starting in east palo alto where the city council is

declaring a local emergency after recent storms damaged the levee at the san francisquito creek. the city is hoping governor jerry brown will declare a state of emergency that will bring much needed money from the state to cover the cost of repairs. a city inspection of the entire length of the creek shows 12 areas in need of immediate help. on capitol hill, the house will vote on aid for superstorm sandy victims. today's vote covers nearly $10 billion for the national flood insurance program. another vote on january 15th will cover the remaining $51 billion in that package. today's vote is expected to pass. and the justice department reached a settlement worth more than $1 billion with the owner of the drilling rig that caused a massive oil spill in the gulf of mexico back in 2010. transocean will now pay $1 billion in civil penalties and another $400 million in criminal penalties. much of that settlement will fund environmental restoration

projects and spill prevention research and training. a federal judge still needs to approve the deal. this morning former arizona congresswoman gabrielle giffords is on her way to newtown, connecticut. giffords and her husband will have a private meeting with families of 20 children and six adults killed during that mass shooting at sandy hook elementary school. giffords herself was injured in a mass shooting in arizona two arizona ago. good news here. the state department says secretary of state hillary clinton is expected to return to work next week after being treated for a blood clot in her head. clinton resting now at home one day after being released from a new york hospital. doctors found that clot during a follow-up appointment stemming from a concussion. >> in venezuela, a political crisis continues to unfold as uncertainty about president hugo chavez's medical condition grows. chavez is now being treated for breathing problems after complications from a severe lung infection. chavez had cancer surgery in

thank you very much on that. this sunday expected to be different from all other sundays in san francisco because it's the first time in history all of the city's parking meters will be fully operational just like monday through saturday. kind of a drag there. it has to be done. "today in the bay's" christie smith live in the city right now with all of the details on the meters ready to roll. >> reporter: good morning, jon. this is going to take getting used to. it's been free on sunday for years. if you forget to pay the parking meter on a sunday, it's going to cost you about $72. that's how much the ticket would be. it's a good thing they make it easy to take your money to pay the meter. credit card, debit card, parking card, coin. you can pay with your cell phone. some religious groups in the city aren't happy about this worried that their congregation will get up and running out on sunday service to feed the markimark i ing meter. they say the change is meters
